Building the Legal Framework of the Information Society: Lessons from Combating Hate Speech

Attempts at weaving the normative fabric of Information Society are preceded by three levels of questions: a legal-philosophical level (Should we regulate?), a legal-practical level (Who should regulate?), and a legal-technological level (How should we regulate?). Analyzing the challenges of these three regulatory dimensions, first independently and then at the example of combating hate speech, this contribution will conclude that the normative method most tailored to the challenges of Information Society is the functional approach.
